TERMS & CONDITIONS

GENERAL

 

The Pictures shown are for illustration purposes. The selling price is for the cake, fruit topping (if any), and chocolate decoration (if any). This does not include other decorative items or utensils.

 

1) PLACING AN ORDER


1.1) To place an order, follow the instructions on the ordering pages of the Website. You are able to correct errors on your order up to the point at which you click on the “Pay Now” button on the “Pay” page.

 

1.2) You must provide the requested information for us to process your order. We reserve the right to request further information from you at any time to enable us to complete your order and/or to comply with regulatory requirements. We will use various procedures to authenticate each transaction. By placing an order, you confirm that the details contained in the order are correct in all respects. The system will display a confirmation page listing out the details of your order. This confirms receipt of your order.

 

1.3) A contract between you and us is formed when we receive your confirmation order and send you a confirmation email that your order has been accepted. Please print a copy of the confirmation page for your records. We may, at any time, decline to process your order or any part of your order for any reason including where insufficient or incorrect information has been provided, authentication has not been possible or an exchange rate has been quoted in error.

 

1.4) You will be required to choose your order payment via credit/debit card or online transfer at the time of online ordering.

 

2) REFUND & CANCELLATION

 

2.1) Order and payment made are not refundable unless damages occur on the product during delivery. Refer to note Damage 

 

2.2) You shall ensure that the delivery address provided to us in your order is within our coverage area.

 

2.3) Any cash refund to your bank will incurred a deduction of 5% bank processing fee from the purchase total amount.

 

2.4) Order/s could be voided if information given is incorrect or purchaser/receiver is not contactable.

 

2.5) The management has the right to cancel or refund any order placed given notice for whatever unforeseen reason that it’s deemed to.

 

2.6) Any cancellation and changes related to the order you are required to give us at least 24 hours of notice prior to the delivery time.

 

2.7) For customized product order, no cancellation or changes can be made after payment is made.

 

3) DELIVERY CONDITIONS


3.1) Delivery is available from Monday to Saturday. Delivery is not available on major public holidays unless stated otherwise.

 

3.2) We deliver to selected areas in KL and Selangor as published in our online page, you are required to check if your address is within our coverage area. If it is not included, you may contact our Customer Service for further enquiry. You  may choose your preferred delivery day and time upon ordering. 

 

3.3) The Sun Bakery products are to be delivered to you at a requested address. We provide same day deliveries for orders confirmed before 1:00 PM. Order placed after 1:00 PM will be delivered the following day or any other day as selected by the customer on the cart page. 

 

3.4) All our products will be delivered by our appointed third party logistic company, during the delivery transit all responsibility will be passed between the logistic company and the customer.

 

3.5) While the delivering driver would like to deliver your item on time, please note that we are not able to promise on the delivery time slot you selected as it’s only a preferred guide time. Delivery could be earlier or later than your preferred time slot as all deliveries are subjected to traffic conditions, weather, and any unforeseen circumstances. Neither the delivering company nor our company will be responsible or compensate for any loss incurred in the delay of delivery date or time.

 

3.6) We will not be responsible for any mistake or delay caused by the customer such as incomplete address, incorrect contact number, or any other incorrect details provided by the customer. This is inclusive if there are no people to receive the item during the delivery at any time.

 

3.7) It is essential that when delivery is confirmed, someone is in to receive the bakery product(s). Our product(s) should not be left on the doorstep out in the sun.

 

3.8) In the absence of a receiver during the delivery, re-delivery can be arranged at additional cost.

 

4) ALTERATIONS & CHANGES


4.1) It is your responsibility to read & check the quote thoroughly; any amendments should be made in writing. Please note that all alterations & changes of orders need to contact our Customer Service team.

 

4.2) All illustrations and descriptions displayed on The Sun Bakery’s website or distributed by email, brochure or in any other way are for guidance purposes only and will not form part of the Contract. 

 

4.3) We are unable to guarantee that all the product-lines used in the construction of our bakery products will be available at the time of making. For example, when a supplier de-lists an item such as a particular birthday tag, etc, we will endeavor to replace this to reflect as closely as possible the spirit of the original design.

 

4.4) In all cases we will try to contact you to advise you of any such changes, however The Sun Bakery reserves the right to replace these items of equal or better quality without consultation. 

 

4.5) We reserve the right to make alterations to the design, appearance and technical specifications of our products from time to time and at such time or at any other times, to make alterations to our advertised information concerning such Goods, without notice.

 

5) DAMAGE

 

5.1) Our cakes are packaged to ensure they arrive as beautiful and as fresh as when they left us. However, on a small number of occasions (and for reasons beyond our control) they may get damaged during transit. 

 

5.2) Should this occur to a level that you deem unacceptable, please contact our customer care at email address/WhatsApp to inform us immediately with images to support your claim so that we can arrange a replacement at our next available delivery date, or a refund. 

 

5.3) For any damage product, please note that you will need to inform us via WhatsApp to our Customer Service contact within 1 hour of receiving the product and email/WhatApps us a photo of the damaged product within 6 hours of receipt in order to be eligible for a refund. 

 

5.4) If we offer you a refund, please note that banks generally take up to 10 business days to process and transfer the funds into your account. Some banks can take up to 15-30 days, or until your next billing cycle. The Sun Bakery has no influence over these timescales. Kindly refer to note (2.3) for bank charges on refund.

 

5.5) Once the cake has been delivered and signed for after the stipulated time mentioned in note (5.1), The Sun Bakery is unable to accept any liability neither for any damage sustained to the cake thereafter nor for any failure to follow the instructions provided.

 

5.6) For product(s) that have been delivered, any missing add-ons for the associated order will be refunded accordingly.

 

6) ALLERGIES & SPECIAL DIETARY REQUIREMENTS


6.1) All our cakes contain gluten, eggs and dairy products, so are not suitable for those suffering from intolerance or allergies to these particular foods. Please be aware that our bakery products may/could contain traces of egg, tree nuts and soy products. The Sun Bakery will not be held responsible for anyone suffering from nut allergies.

 

6.2) Non-edible items may be used as decorations or packaging for the bakery products. It is your responsibility to ensure that any non-edible items are removed prior to consumption.

 

7) CERTIFICATION

 

7.1) Our bakery products are HALAL certified to the highest standard from the Department of Islamic Development of Malaysia (JAKIM). 

 

8) FORCE MAJEURE


8.1) Neither we, nor any delivery service that we use shall be liable for any failure to perform, where such failure or delay results from any circumstances outside our reasonable control including but not limited to any fire, flood, explosion, accident, adverse weather conditions, traffic congestion, mechanical breakdown, obstruction of any private or public highway, riot, government act, act of war, terrorism, act of God, or from any industrial dispute or strike whatsoever.

 

9) STORAGE & CONSUMPTION


9.1) The Sun Bakery would like to recommend that the bakery product(s) purchased are best eaten within 48 hours from collection/delivery. However, should you need to keep, it is advisable to be stored in the freezer at -18°C and brought back to room temperature at 0-4°C before consuming. We do recommend that our bakery products are best eaten up to 3 days after collection/delivery. It is the responsibility of the customer to keep the product(s) in the manner prescribed by us.

 

10) OFFERS AND PROMOTION CODES

 

10.1) At our discretion, from time to time, we may offer products at discounted prices. These offers are valid from the time that we introduce them to the end date of the offer and they cannot be used for purchases before the offer introduction date or after the offer end date.

 

10.2) In the event that a customer has made a purchase and the price of the purchased product subsequently falls or is discounted owing to a special offer, the price of the product at the time of purchase shall prevail. We are unable to offer special offer discounts for purchases that have already been made.

 

10.3) As our special offers are contingent on availability, we may change the terms of special offers, or withdraw them altogether, at any time, and without prior notice.

 

10.4) We also reserve the right, at our absolute discretion, to offer different personalized special offers and promotions and it will therefore only be possible for the customer in receipt of the special offer to redeem the discount.

 

10.5) Unless explicitly otherwise stated, free or discounted introductory offers are only available to new users of the The Sun Bakery, and are only available once to any one person.

 

10.6) Discounts and credits cannot be used in conjunction with any other offers.

 

10.7) Unless otherwise stated, we only allow one promotion code to be used per order.
